A company based abroad can temporarily second employees to work for another company in France. For any such activity, the company must appoint a legal representative in France.
Our staff speak French, Italian, English, Spanish, German and Polish, and will be happy to provide you with information and advice on the prior declaration of transnational secondment, which must be submitted in French to the labour inspectorate, the creation of the SIPSI account, and formalities such as the A1 form (relating to social security for expatriates or non-resident employees).
LEGAL FRAMEWORK: A 1996 European directive defined the posting of employees. Its scope and implementation procedures were clarified by the 2014 directive.
In France, the law of 6 August 2015 known as the « Macron law » implemented several measures aimed at strengthening the fight against fraud involving the posting of workers by companies established abroad.

ACTIVITIES COVERED BY SECONDMENT
The following activities are eligible for employee secondment:
- Provision of services: industrial, commercial, craft, liberal or agricultural activity.
- Intra-group mobility: provision of staff between companies in the same group for a mission or training
- Provision of temporary workers: a temporary employment company may second employees to a company in France for occasional assignments
- Operation for its own account (self-provision): a company established abroad may temporarily second employees to France for one-off missions
- land rolling transport activities are affected by the detachment rules . However, certain specific measures are applied to this sector of activity (certificate of compulsory secondment).
