SECONDMENT REGULATIONS FOR FOREIGN COMPANIES

At the end of a period of 12 months of secondment, the directive of 28 June 2018 stipulates that any posted worker will be subject, from the thirteenth month not only to the «Core» of the legal and contractual provisions, but to all the provisions of the labour code. 

The foreign company must register at least as a foreign company employing workers in France without a permanent establishment, or open a permanent establishment, secondary.

According to decree no. 2020-916 of July 28, 2020 on seconded workers and the fight against unfair competition, all nationals of member states of the European Union (EU), the European Economic Area (EEA), Switzerland, Monaco, Andorra and Saint Martin will be required to show proof of their nationality, in accordance with the principle of free movement. If the employee has never been registered in France, an application for registration with the CPAM must be made.

 In the case of EU and EEA nationals, the foreign company must comply with the usual recruitment formalities:

 

  • Employment contract written in French 
  • Delivery of the monthly salary bulletin

 

Any foreign employee in a legal situation must, without discrimination, enjoy the same rights as a French employee:

 

  • Paid leave 
  • Compliance with the minimum wage (minimum wage) 
  • Right to unemployment 
  • Health and safety rules


It is the company’s right to hire French personnel or those with a residence permit by applying the rules of French labour law and/or the collective agreement of attachment.
